I need to create down payment with tax, but when I create one (by percentage or fixing price) tax is not calculate.
What should I do for this?

Check whether you have previously processed another down payment against the same Sales Order. The system automatically picks up the tax rate from the previous down payment line in such cases.
You can add tax to the "Down Payment" product and that will be applied automatically, but it's not a good solution if different products have different tax rates.
